Terms of Service - GAflow Banking Analytics

1. Agreement to Terms

By accessing and using GAflow ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

GAflow is a banking analytics platform that provides conversion funnel optimization, customer journey mapping, and real-time analytics services specifically designed for banks, credit unions, and financial institutions.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

Safeguarding the password and all activities that occur under your account
Maintaining the security of your account and password
Immediately notifying us of any unauthorized use of your account
Ensuring your use complies with applicable banking regulations

4. Acceptable Use

You agree not to use the Service:

For any unlawful purpose or to solicit unlawful acts
To violate any international, federal, provincial, or state regulations or laws
To transmit or procure the sending of any advertising or promotional material without consent
To impersonate or attempt to impersonate the Company, employees, users, or others
In any way that infringes upon the rights of others

5. Subscription and Billing

GAflow offers subscription-based services with the following terms:

All subscriptions include a 14-day free trial period
Subscriptions are billed monthly or annually as selected
Payment is processed through Stripe, our secure payment processor
You may cancel your subscription at any time
Refunds are provided on a case-by-case basis within 30 days of billing
We reserve the right to modify pricing with 30 days advance notice

6. Data Security and Compliance

We understand the sensitive nature of banking data. GAflow maintains SOC 2 compliance and implements bank-grade security measures including end-to-end encryption, secure data transmission, and regular security audits. However, you remain responsible for ensuring your use of our service complies with all applicable financial regulations including GLBA, PCI DSS, and other banking compliance requirements.

7. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of GAflow and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

8. User Data and Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Service Availability

We strive to provide reliable service but cannot guarantee 100% uptime. We provide:

99.9% uptime SLA for paid subscribers
Planned maintenance notifications with 24 hours advance notice
24/7 monitoring and incident response
Service credits for significant downtime events

10. Limitation of Liability

In no event shall GAflow, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, punitive, consequential, or special damages, including lost profits, data, or use, incurred by you or any third party, whether in contract, tort, or otherwise.

11. Indemnification

You agree to defend, indemnify, and hold harmless GAflow and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees).

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately, but your data will be available for export for 30 days.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days advance notice prior to any new terms taking effect. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
